and you need not be in Spain for any of them

Buying property in another country sounds harder than it is. Our partner lawyer runs the whole file and keeps you informed at every step.

NIE number

Your Spanish tax identification number, applied for on your behalf. Two to three weeks.

02

Reservation

A reservation deposit takes the home off the market while the lawyer does the due diligence.

03

Private contract

Signed once title, licences and charges are verified. For a finished home, typically 10% of the price plus VAT. In the new phases, the first payment of the developer's schedule.

04

Notary

The deed is signed and the balance paid. You can sign in person or through a power of attorney.

05

Keys

Registration, utilities and the community handover. A finished home is yours the same week, and in the new phases the keys come on completion.

11Questions

The questions that come up
on the first call

Yes, and nothing about the purchase itself has changed. There is no restriction on non-EU nationals owning property in Spain. What changed is how long you may stay without a visa and the non-resident tax rate, and both are covered below.
As a non-EU visitor you may spend 90 days in any rolling 180-day period in the Schengen area. For longer stays the usual routes are the non-lucrative visa, for those not working in Spain, or the digital nomad visa. EU citizens have no limit at all. We will introduce you to an immigration lawyer before you commit, not after.
For a new build bought from the developer, VAT at 10% and stamp duty (AJD) at 1.2% in Andalusia, plus notary, land registry and legal fees. Altogether, budget 12–13% above the listed price. The calculator above works it out for each home.
Community fees, IBI (local property tax), refuse charges and home insurance. Andalusia has in practice removed its wealth tax through a 100% rebate, which matters at this price level. The developer confirms the exact community fees of each building in writing, so ask us for the current figure rather than an estimate.
Yes. A power of attorney, signed at a Spanish consulate or before a notary at home with an apostille, lets your lawyer sign everything on your behalf. Several of our buyers have completed without a single flight, though we would still rather you saw the terrace in person.
The first phase and the circular building are finished, so you can walk through those homes this week and move in after the deed. The second and third phases are under construction, and the completion date of each home is set out in its contract. Every photograph on this page was taken on site, and under each one we say where.
You own the home and its terrace and, depending on the home, the garden with its pool or the roof terrace. In the new phases the ground-floor garden and pool are a communal area reserved for the private use of that home. Parking and a storage room come with every home. The gardens, pools, spa, gym and security are common areas of The View Marbella, maintained by the community.
Long-term letting is generally allowed. Short-term holiday letting depends on the community statutes and on registering the property with the Junta de Andalucía. We will send you the statutes before you reserve, so you can read the rule for yourself.
For a finished home, about three months from reservation to keys, and the longest single wait is usually the NIE number. If you already have an NIE, six to eight weeks is realistic. In the new phases the keys come on completion.
Non-resident income tax is charged on an imputed value of the property, at 19% for EU and EEA residents and 24% for everyone else, the UK included. If you let the property, the rate applies to the rental income, and EU residents may deduct expenses. Your lawyer will work it out on your actual figures.
For a finished home you pay at the notary in exchange for the deed, once your lawyer has verified the title. For a home still being built, Spanish law requires the developer to guarantee every payment made before completion with a bank guarantee or an insurance policy, and our partner lawyer checks it before you pay anything.
Typically up to 60–70% of the valuation for non-residents, subject to income. We can introduce you to two brokers who work with buyers in this bracket. There is no obligation, and we take nothing from them.
The price covers the home fully finished, with the fitted kitchen and bathrooms, climate and smart-home systems, parking and a storage room. Furniture is not included unless a special offer says so, and a furniture package can be quoted separately if you would like the home ready to live in.
